Is my agency criminally exposed for taking German cases in Mexico?
No. § 1 of the Embryonenschutzgesetz (ESchG) criminalizes German-based intermediation of surrogacy — it does not extend extraterritorially to Mexican agencies serving intended parents who travel to Mexico. This is a documented and defensible position under German criminal-law scholarship. We walk through the specific analysis on the live session.
My agency has never taken a German case. Is this webinar useful for us?
Yes, arguably more useful. The framework is designed to let agencies open the German market with defensible legal infrastructure from day one, rather than learn on live cases. Every deliverable applies whether you have taken zero German cases or twenty.
How long does the § 108 FamFG recognition proceeding really take?
Typical range 3 to 6 months from filing, provided the intake and contract were built correctly. Cases with missing egg-donor documentation, undisclosed prior proceedings, or ordre public objections extend materially — sometimes to 12 or 14 months if the case routes to stepchild adoption fallback. The Screening Protocol and Contract Rider are designed to keep cases in the shorter window.
Will the deliverables work for U.S., South African, or other cross-border configurations?
The framework is designed for the German-side legal architecture, which is jurisdiction-of-arrival-driven, not jurisdiction-of-origin-driven.
